Terms & ConditionsGeneral Terms & CondititonsIn these conditions "the Company" means Holiday Marketing Pty Ltd trading as Beachcomber Tours (Lic TAG1291 ACN 066 954 381) and "the Client" means the person in whose name or on whose behalf the reservation is made. 1. HOLIDAY PRICE The prices quoted by the Company in this brochure are based on airfares, tariffs, taxes and rates of exchange at 30 September 1999. The Company expressly reserves the right to adjust the prices in accordance with airfare increases, currency fluctuations, tax or tariff adjustments which may occur after 30 September 1999, but before the Client’s departure date. 2. RESERVATIONS A minimum deposit of $200 per person must be paid by the Client at the time of making a reservation. The balance of the price must be paid 8 weeks prior to departure. The Company reserves the right to cancel any reservation for which the total price has not been paid by the due date, in which event the Client’s deposit will be forfeited to the Company. The Company reserves the right to apply a $30 late booking fee for bookings made within 7 days of departure and a $30 amendment fee for each alteration made to bookings after the initial reservation. Insurance should be taken out to cover loss of deposit. 3. DELAYS The Company will not be liable for any delays prior to departure or during the course of any holiday mentioned in this brochure, whether brought about by technical difficulties, strikes, weather conditions or any other circumstances whatsoever. Any expenses relating to these delays (eg: hotels, meals, telephone calls, etc) must be paid by the Client. Travel insurance is strongly recommended. 4. UN-USED SERVICES The Company will not be liable to give the Client a refund for any unused services, irrespective of whether they form part of the basic inclusive holiday price, or whether they are in respect of pre-booked optional arrangements. 5. LOCAL REPRESENTATIVES Holidays in this brochure do not include the services of a tour leader from Australia. The Company prefers to employ the services of local representatives in Mauritius and other countries. 6. HOTELS All hotels recommended by the Company in this brochure have been personally inspected by our staff. The Company reserves the right to change the hotel requested by the Client to a hotel of a similar or better grade, even after departure from Australia. 7. ITINERARY VARIATION While every effort is made to comply with all published itineraries, the Company reserves the right to make changes to itineraries for your convenience. In some cases, weather conditions can necessitate an alteration in the tour itinerary and this will not constitute any basis for a refund. 8. AIRLINE RESPONSIBILITY The ticket issued by the airline to the Client will constitute the sole contract between the airline and the Client. 9. PASSPORTS AND VISAS All passports and visas must be obtained by the Client through his or her Travel Agent before departure. The Company is not responsible for obtaining the ClientÕs travel documents and accept no liability for incorrect documents. 10. TRAVEL DOCUMENTATION The Client will be responsible for ensuring that he or she obtains the correct travel documentation prior to travel. The Company will not be liable for any consequences arising from the Client failing to ensure that he or she has complied with all necessary requirements for travel such as health, passport or visa requirements. 11. TO CANCEL A RESERVATION Cancellations of reservations must be made in writing to the Company and will incur cancellation charges in accordance with the following table: * More than 8 weeks notice: deposit forfeited * Less than 8 weeks notice: 25% of holiday price * Less than 6 weeks notice: 30% of holiday price * Less than 4 weeks notice: 40% of holiday price * Less than 3 weeks notice: 60% of holiday price * Less than 2 weeks notice: 80% of holiday price * Less than 1 weeks notice: 100% of holiday price If the Client misses his or her departure flight, or fails to leave as planned, no portion of the holiday price will be refunded by the Company. PLEASE NOTE: Special Terms and Conditions apply to bookings made on Beachcomber's website. SPECIAL REQUESTS The Client must specify any requests for the holiday at the time of making the reservation. The Company will accept special requests on the understanding that whilst every effort will be made to comply with the requests, under no circumstances will the Company guarantee the request. The Company will not be liable for any loss, damage or consequential expense incurred by the Client due to the failure of the Company to meet the Client’s special needs. 13. LIABILITY Nothing in these conditions shall be read or applied so as to exclude, restrict or modify any condition, warranty, guarantee, right or remedy implied by law (including the Trade Practices Act 1974) and which by law cannot be excluded, restricted or modified. The Company acts as an agent only in producing and operating the tours and arrangements featured in this brochure. The Company shall not be liable to the Client for (a) Any death, personal injury, sickness, damage, accident, delay, consequential loss or other irregularity. (b) Any act, omission or default of any hotel company, air carrier, supplier or other person, or by any servant or agent of the same name. (c) Any changes, omissions or delays, before or during the course of any published holiday (d) Loss or damage to baggage and other personal effects, whether temporary or permanent; however caused and whether due to negligence of any person or not. Any liability of the Company to the Client will be limited to the total amount paid or agreed to be paid by the Client to the Company for the holiday. Any claim which the Client may have must be notified within 14 days of return from the holiday. The Company will not entertain any claim notified after this period. 14. PRICES DO NOT INCLUDE Prices quoted in this brochure do not include costs of obtaining visas, passports, telephone calls, laundry, entertainment arrangements not shown in the itinerary, meals, beverages unless actually specified, and any other items of a personal nature. Prices do not include GST. 15. GST If a Goods and Services Tax (or similar) becomes payable in respect to any supply of goods or services provided by the Company or any third party, the Client will be solely responsible for the additional payment, irrespective of whether final payment (excluding GST) has been made. 16. HOTELS In the unlikely event that a hotel is unable to provide accommodation previously confirmed, the Company reserves the right to relocate the Client to the appropriate alternative accommodation. 17. GROUPS Group terms, conditions, deposits and cancellation fees may vary from those previously indicated. 18. GENERAL INFORMATION (a) Travel & Medical Insurance Clients are strongly recommended to take out travel and medical insurance to cover personal accident, medical expenses, loss of baggage and personal effects, loss of deposit or tour fare through delays, cancellations and other unforeseen events. (b) Baggage A baggage allowance of 20 kg per person is permitted on international flights and is subject to airline conditions. Inter-island flights or flights within Africa may impose baggage restrictions. (c) Reconfirmation Clients are reminded that they are responsible for reconfirmation of flights. Please refer to your airline ticket. Failure to reconfirm may result in the cancellation of a flight reserved by the airline. (d) Brochure & Information Whilst every care has been taken in producing this brochure, the Company will not be held liable for information and photographs that may have changed prior to printing or during the course of the brochure.
